For carriers writing small employer group health contracts to Illinois employers, this bulletin will serve notice that the Department has adopted an administrative regulation (50 Ill. Adm. Code 5101) which was adopted effective December 19, 2000 and was published in the Illinois Register on December 29, 2000, on page 19162.

The Director's prior and future bulletins on this topic will remain applicable and must be adhered to in order to meet the requirements of the Small Employer Health Insurance Rating Act [215 ILCS 93/1 et seq.] and Part 5101, especially in determining the application of the Actuarial Standards of Practice No. 23. Company bulletins are available on our website (http://www.ins.state.il.us/company/lifeactuarial.htm).

As a point of clarification, in Section 5101.60 (j), it should be understood that the reference to "the annualized premium dollar amount for groups whose actual premium rates were tested..." will include amounts from groups who may have terminated during the year and thus were not necessarily in force at year end.

The Department will mail notice of any future additions to the information contained in the web site to plan personnel or consulting actuaries concerned with 215 ILCS 93 compliance who send a request to be added to the mailing list. The request should be submitted to Lynn Shanklin at the e-mail address listed above. The request should contain the full name and e-mail address for the person/entity wishing to be added to the mailing list.
