The following Department policy has been developed in response to the Federal Women's Health and Cancer Rights Act 1998 (WHCRA) (42 USC 300gg-6, 300gg-52, incorporating 29 USC 1185(b)).
All companies are required to be in compliance with the provisions of the Federal Women's Health and Cancer Right's Act of 1998. The Department will enforce all the provisions of the Federal Women's Health and Cancer Rights Act including any instances where there are conflicting or inconsistent standards or requirements in the Illinois Insurance Code or the Health Maintenance Organization Act.
