The following Department policy has been developed in response to the Federal Mental Health Parity Act of 1996.

All companies are required to be in compliance with the provisions of the Federal Mental Health Parity Act, Section 2705, title XXVII of the Public Health Service Act. In any instances where there are conflicting, inconsistent or less restrictive standards or requirements in the Illinois Insurance Code or the Health Maintenance Organization Act, the provisions of the Federal Mental Health Parity Act shall take precedence.
