Boozell named Governor's chief of staff

Mark Boozell

Effective March 1, 1998, Director Mark Boozell will depart the Illinois Department of Insurance to accept a new challenge in Governor Jim Edgar's administration. The Governor, who is not seeking reelection, has asked the Director to serve as his Chief of Staff for the duration of his term.

"Mark Boozell is a talented young man who has risen through the ranks of this administration. Mark's experience and his record of innovative leadership at the Department of Insurance make him a strong choice to lead the Governor's Office through what will be a busy and important year," Edgar said.

In addition to his cabinet post as insurance director, for several months in 1997 Boozell also spearheaded Governor Edgar's successful campaign to refinance public education funding in Illinois.

"I am privileged and excited to rejoin Governor Edgar's staff," Boozell said, "but it is not easy to leave the Department at a time when we are moving in a very positive direction. I've enjoyed my association with our staff and the opportunity to shape our regulatory strategies.

"One of the programs I am proudest of is Illinois' significant presence on the Internet. In the past 2 ½ years, we have made important strides in consumer education and Internet technology has been at the center of much of that effort. We've also made inroads in other aspects of insurance regulation that benefit the insurance consumer. The initiatives that come most readily to mind include health insurance compliance, the entrance of banks into the Illinois insurance market, and our new insurance company investment act.

"As I leave the Department of Insurance, I have every confidence that Illinois will continue to hold its rightful place as a regulatory leader."

At press time, the Governor had not yet announced Boozell's successor.

Illinois' Gorski receives NAIC's highest individual award

The National Association of Insurance Commissioners has honored Larry M. Gorski, Life Actuary for the Illinois Department of Insurance, with it most prestigious individual award — the Robert Dineen Award.

"This year's honoree has a long history of service to the Illinois Department of Insurance and the National Association of Insurance Commissioners. He has worked tirelessly on a wide array of regulatory issues, including actuarial practice, investments, reinsurance, insurance education programs, and financial reporting. His efforts have resulted in a lengthy list of innovations, solutions, improvements and enhancements to the state regulation of insurance," said NAIC President and Wisconsin Insurance Commissioner Josephine Musser in presenting the award in Seattle, WA, on December 8, 1997.

Gorski joined the Illinois Department as an Actuarial Examiner in the Life, Accident & Health Division in 1973. He has served as Chief Actuary of the Life Actuarial Section in the Financial-Corporate Regulatory Division since 1976.

"Larry has been invaluable to the Illinois Department of Insurance and the NAIC. He has contributed to the advancement of state regulation of insurance through his leadership, advice and service. He is recognized nationally for his expertise in a broad range of regulatory issues," said Illinois Director Mark Boozell, who recommended Gorski for this highly prestigious award.

Gorski's many NAIC assignments include: the Financial Condition Subcommittee, the Accounting Practices and Procedures Task Force, the Risk-Based Capital Task Force, the Valuations of Securities Task Force, the Life Insurance Committee, and the Life and Health Actuarial Task Force.

"Larry is an innovator. Time and time again, he has been at the forefront of breaking investment issues. He has been able to anticipate potential problems well in advance and has helped to seek solutions before those problems become serious. At times, it seems he has virtually limitless energy and he has been very creative in problem solving," Musser said.

"Larry's selection marks the second time in the award's nine year history that a staff member of the Illinois Department has been recognized," Boozell noted. "I think that speaks volumes, not only about the professionalism of our staff, but about the value of Illinois' role in the NAIC." Former Chief Deputy Director, Jim Schacht, received the award in 1990.

Congratulations

The Illinois Department also congratulates staff member Sarah J. Fore who recently completed the exam requirements for membership in the Casualty Actuarial Society. A magna cum laude graduate of Illinois State University, Sarah joined our Casualty Actuarial staff in August of 1996. She will be awarded the Associate of the Casualty Actuarial Society (ACAS) designation at the group's Spring Meeting in May.

Illinois Supreme Court overturns state privilege tax

On October 23, 1997, the Illinois Supreme Court declared the Illinois insurance privilege tax unconstitutional when it issued its ruling in the case of Selcke v. Milwaukee Safeguard Insurance Company (Supreme Court Docket No. 82047). On November 12, 1997, the state filed a Petition for Rehearing which stayed the decision until the Court denied the Petition on December 1. The decision became final at the close of business on December 11, 1997, when the Court issued its mandate to the trial court in Cook County.

The Supreme Court decision held that Section 409 of the Illinois Insurance Code was unconstitutional under the Illinois Constitution's Uniformity Clause because, on its face, the tax it imposes on foreign insurance companies does not bear a reasonable relationship to the object of the legislation or to public policy. Because the Illinois Supreme Court based its ruling solely on its application of the Uniformity Clause of the Illinois Constitution, we could find no adequate legal or practical grounds for appeal to the U. S. Supreme Court. Thus the Illinois insurance privilege tax [215 ILCS 5/409] has been rendered invalid and unenforceable.

The case has been remanded to the trial court for further proceedings involving plaintiffs' challenge regarding the application of Sections 444 and 444.1 of the Illinois Insurance Code [215 ILCS 5/444 and 5/444.1] and the state's claims of an offset against the amounts in the statutory protest account for alternative retaliatory taxes.

The Illinois Privilege Tax has been subjected to a variety of constitutional challenges since 1981 following the U.S. Supreme Court's decision in the case of Western & Southern Life Insurance Company v. State Board of Equalization Of California, 451 U.S. 648 (1981). In that case the Supreme Court upheld a retaliatory tax framework employed by most states. However, it overturned earlier case law which had held that state insurance taxes were not subject to the Constitutional standard set forth by the Equal Protection Clause of the Fourteenth Amendment.

Individual health insurance market stable -

CHIP functioning as alternative mechanism for HIPAA

As other states report serious disruption and large premium increases resulting from guaranteed issue in their individual health insurance markets, Illinois is currently experiencing no such problems. The Illinois Comprehensive Health Insurance Plan (CHIP) was designated as the alternative mechanism to guarantee issue for the individual health insurance market in response to the Health Insurance Portability and Accountability Act of 1996. CHIP is now able to offer a choice of alternative portability health benefit plans to federally eligible individuals — Plans 4 & 5, in addition to Plans 1-3 offered under the traditional CHIP.

Benefits and premiums for Plans 4 and 5 are similar to the existing Standard Plan (Plan 1) and Hospital PPO option (Plan 3) except that neither of the new plans contains any waiting period or exclusion for preexisting conditions. There will never be a waiting list for Plans 4 and 5, and there has been no waiting list for Plans 1-3 since January 1996.

Additionally, the lifetime maximum in benefits for each individual covered by CHIP was increased from $500,000 to $1 million as of July 1, 1997. CHIP began enrolling federally eligible individuals on July 1, 1997, and, as of the first week of January 1998, has enrolled approximately 500 Illinois residents.

Eligible Illinois residents can apply for any of the health benefit plans that are available under one of the state's two CHIP programs directly through the Board office, or through any producer licensed to sell health insurance in Illinois.

Parents or legal guardians of the person may apply on behalf of resident dependents or other legally incompetent individuals. Guardian or power of attorney papers are required.

Legislative update

House Bill 1400 (PA 90-567) was effective 1/23/98. The bill amends the CHIP Act, the Illinois Health Insurance Portability and Accountability Act (HIPAA) and the Health Care Purchasing Group Act to comply with the federal HIPAA law and add an appeal process for insurance company assessments authorized in PA 90-30.

Department rules review

The full text of Department rules is printed in the Illinois Register published weekly by the Illinois Secretary of State's Index Department, 111 E. Monroe St., Springfield, IL 62756. Subscriptions are available from that source for an annual fee of $290. Issue numbers and a Department contact person are listed below after each rule summary.

Copies of rules are also available upon written request to the Department of Insurance at a $1 per page charge. Adopted rules are codified in Title 50 of the Illinois Administrative Code.

Rule 5421 (Health Maintenance Organizations) was amended by emergency rule effective November 18, 1997, to implement statutory changes found in Public Act 90-037. The new law allows HMOs to make basic outpatient preventative and primary health care services available to children under the age of 19 who are otherwise unable to obtain health care benefits. Although the emergency rule will expire on April 16, 1998, the rule is also going through the regular rulemaking process and will be submitted for second notice in February.
