Arnold Dutcher appointed acting director

Arnold Dutcher

Governor Jim Edgar has named Arnold Dutcher as the Illinois Department's Acting Director to succeed Mark Boozell who returned to the Governor's office as Chief of Staff on March 1, 1998.

In announcing the appointment, the Governor expressed confidence that Dutcher's 25 years of experience in the Department will guarantee continuity and stability at the agency during the final year of the Edgar administration.

"We are fortunate to have a career employee as skilled and experience as Arnold Dutcher on hand to step up and direct a department as important as Insurance," the Governor said. "I am confident he will maintain the programs and the leadership that have kept Illinois insurance consumers protected and well informed, and that have helped ensure a strong and open statewide insurance marketplace."

Over the past two and a half decades, Dutcher has risen through the Department's ranks and has held a series of key supervisory assignments, including stints as Deputy Director of the Financial-Corporate Regulatory Division and Deputy Director of the Life, Accident and Health Division. He has been Chief Deputy Director since August 1995.


Since 1978, Dutcher has actively represented Illinois before the National Association of Insurance Commissioners, where he continues to chair or participate in numerous accounting, financial, reinsurance, and examination subcommittees and working groups. A U.S. Army veteran, he holds bachelor's degrees in accounting and marketing from Southern Illinois University-Carbondale, and a Fellow Life Management Institute (FLMI) designation from the Life Office Management Association.

In other staff changes, Robert Burke resigned as Chief Examiner for the Life, Accident and Health Financial Examination Section effective February 28. Bob joined the Department's financial exam team in 1964 and was appointed Chief Examiner in 1970. During his tenure, he served terms as President of both the National Association of Health Maintenance Organizations Regulators and the Society of Financial Examiners.

He is succeeded by Kenneth Skiera who has served as Assistant L/A&H Chief Examiner since 1979.

Rules addressing life insurance solicitations and advertising adopted in tandem

Department Rule 1406 (Individual and Group Life Insurance Policy Illustrations; 50 Ill. Adm. Code 1406) and amendments to Rule 930 (Life Insurance Solicitation; 50 Ill. Adm. Code 930) will both be effective June 1, 1998.

The purpose of Rule 1406 is to provide standards for both individual and group life insurance policy illustrations that will protect consumers and foster consumer education. The Illinois rule mirrors the NAIC Model Life Insurance Policy Illustrations Regulation in all but three areas:

Rule 1406 requires the insurer to distinguish whether an illustration is for an individual or a group life insurance policy; the Model Regulation does not require a distinction.

Rule 1406 assigns a specific date, "no later than December 31," by which an insurer must file its annual compliance certification; the Model Regulation indicates that annual certifications shall be provided each year by a date determined by the insurer.

In the Illinois rule, the language contained in the illustration statement, signed by the applicant and agent, addressing the applicant's understanding of the non-guaranteed elements of the illustration differs slightly from the language contained in the Model.

The amendments to Rule 930 add definitions of guaranteed and non-guaranteed elements and clarify policy summary requirements. Only "guaranteed elements" may be shown in the policy summary. Thus if a company sells a policy using an illustration subject to the requirements of Rule 1406, it is not required to provide a policy summary.

U.S. withdraws appeal in Reserve superpriority case

The United States Department of Justice, on behalf of the United States government, has withdrawn its appeal in the Reserve Insurance Company "superpriority" case.

By dismissing its appeal, the United States has let stand the key priority ruling which former Insurance Director Mark Boozell had won from District Court Judge Reuben Castillo. Judge Castillo agreed that claims brought by the federal government against the Reserve estate are subject to Illinois Receivership law, including claim filing deadlines, and are not entitled to superpriority ranking ahead of consumers' claims. Castillo also rejected the United States' contention that the statutory role of guaranty associations invalidated the priority provisions of the Illinois Insurance Code.

Discussions are now underway with the Department of Justice for a possible voluntary dismissal of Boozell's cross-appeal of other aspects of Judge Castillo's decision. If an agreement on the remaining issues can be reached and the cross-appeal dismissed, the Reserve estate can be closed and a final distribution of assets can be made to Reserve's creditors.

HIPAA/CHIP provides real help for Illinois residents with serious health conditions

The Comprehensive Health Insurance Plan (CHIP) continues to implement new federal requirements of the Health Insurance Portability and Accountability Act (HIPAA). Eligible Illinois residents who have exhausted their right to continue prior group coverage and have run out of options for securing their own individual policy are finding comprehensive coverage with CHIP with no exclusion for pre-existing conditions.

Among the first 500 persons to take advantage of this new HIPAA/CHIP program was Amy Marie Gardner of Glenview. She learned of her potentially fatal kidney disease during a routine physical while she was a college student. She exhausted coverage under her parents' health plan and became eligible for Medicare for three years after receiving a kidney transplant in 1993.

Amy finished college and set out to get a job in her chosen field -- teaching. That job also provided her with group health insurance coverage. However, in a classroom of children Amy was exposed to more germs than her system could tolerate. Not only did she have to find another job, she also had to worry about having health insurance.

Amy later secured another job and had coverage under her new employee's group health plan, but the job wasn't in her field and it wasn't the work she loved to do. It did, however, provide health insurance. "The new kidney saved my life," says Amy, "but without the immunosuppressive medications I could lose it." Her previous medical history made her uninsurable in the private market. Drugs and regular lab testing fees together cost over $2000 a month so maintaining health insurance coverage was critical for her.

Because of HIPAA/CHIP Amy was able to look for a job in her chosen field "without insurance being the primary factor." She now has a new job she loves and it doesn't matter that her new employer is unable to provide health insurance benefits. After exhausting her COBRA benefits under her previous employer's group health plan, Amy became eligible for HIPAA/CHIP and is now covered by CHIP with no exclusion for her pre-existing condition.

Dr. Janis Orlowski, Executive Dean of the Rush Medical College, a kidney specialist at the hospital and a CHIP Board Member remarked, "This is an outstanding program that the state has implemented for individuals like Amy Gardner with a history of serious medical problems. It is very significant that she and others like her who have had excellent health care benefits through their employer and then move to another job without such benefits, become self-employed, or retire can be covered by CHIP without having to satisfy another exclusion for pre-existing conditions."

The new HIPAA/CHIP plan has enjoyed a successful inaugural period through the first six months of fiscal 1998, according to CHIP Executive Director Richard W. Carlson. All states were required to assure that federally eligible individuals can obtain individual health coverage on a guaranteed issue basis with no pre-existing condition exclusions as of January 1, 1998. However, Illinois may be one of the few to have successfully implemented its alternative mechanism six months early. In fact, as of February 27, 1998, CHIP has received nearly 1200 applications for HIPAA/CHIP and has enrolled more than 700 eligible individuals.

"While other states have experienced some of the glitches that are common to new, federally-mandated programs," Assistant Insurance Director Madelynne Brown observed, "we in Illinois were able to use our experience and expertise with CHIP to smooth the way for a successful plan initiation. Portability of coverage and the elimination of waiting periods for pre-existing medical conditions are the key to the eventual effectiveness of these new requirements."

"The agonizingly steep costs of health care make portability of coverage to CHIP absolutely essential for many of our eligible clients," Carlson said. "These individuals who change jobs or retire either willingly or without choice now have the security of knowing that they can obtain health coverage under the HIPAA provisions of CHIP without having to satisfy a new pre-existing condition exclusion."

Legislation update

House Bill 2179 (PA 90-559), effective 6/01/98 -- Amends the Illinois Vehicle Code to make a second or subsequent conviction for operating a vehicle when registration is suspended for not having insurance, a Class B misdemeanor. Provides that the vehicle can be impounded when a person drives without a license or permit and without insurance.

Department rules review

The full text of Department rules is printed in the Illinois Register published weekly by the Illinois Secretary of State's Index Department, 111 E. Monroe St., Springfield, IL 62756. Subscriptions are available from that source for an annual fee of $290. Issue numbers and a Department contact person are listed below after each rule summary.

Copies of rules are also available upon written request to the Department of Insurance at a $1 per page charge. Adopted rules are codified in Title 50 of the Illinois Administrative Code.

Rule 909 (Advertising and Sales Promotion of Life Insurance and Annuities) and Rule 930 (Life Insurance Solicitation) have been amended to make the language consistent with the new NAIC Life Illustration Model Rule. The changes become effective June 1, 1998. (Vol. 22, #6; Betty Jo Teer)

Rule 1406 (Individual and Group Life Insurance Policy Illustrations) has been amended effective June 1, 1998, to provide standards for both individual and group life insurance policy illustrations that will protect consumers and foster consumer education. The rule provides illustration formats, prescribes standards to be followed when illustrations are used, and specifies required disclosures in connection with each illustration. The rule will ensure that illustrations do not mislead consumers and help them make better informed coverage decisions. (Vol. 22, #6; Betty Jo Teer)

Rule 2012 (Traditional Long-Term Care Insurance) was amended effective January 6, 1998, to make it consistent with the latest NAIC model regulation. (Vol. 22, #4; Linda Fritz)

Rule 2051 (Preferred Provider Program Administrators) was amended effective December 9, 1997, to add definitions, change the due date of renewals from March 1 to January 1 and increase the application fee to $250 and the renewal fee to $150. The amendments also add new sections that specify application filing requirements; language for provider and payor contracts, and credentialing, accessibility and availability, and advertising and solicitation standards; and authority for a gatekeeper option. Rule 4404 (Portability of Creditable Service Time for Downstate & Suburban Police Pension Funds) was adopted to implement Public Act 90-460 which requires the Department of Insurance to establish methodology for calculating the true cost of transferring creditable service time for certain public pension funds. This rule was adopted on an emergency basis effective December 9, 1997. Although the emergency rule will expire on May 8, 1998, the rule is also going through the regular rulemaking process. Rule 4430 (Investment Fee Disclosure Requirements for Pension Funds) was adopted on an emergency basis effective December 16, 1997, to implement Public Act 90-507 which allows pension funds to make permitted investments beginning January 1, 1998. The rule addresses fee disclosure to ensure that pension funds obtain adequate information about the actual fees and costs incurred in conjunction with investment transactions. Because the emergency rule will expire on May 15, 1998, the rule is also going through the regular rulemaking process. (Vol. 21, #52; Jim Orr)

Rule 5100 (Small Employer Carrier Actuarial Certification and Documentation Requirements) was repealed effective January 13, 1998. The rule had implemented Section 45 of the Small Employer Rating, Renewability and Portability Health Insurance Act which was repealed by Public Act 90-0030 on July 1, 1997. Rule 5421 (Health Maintenance Organization) was amended on an emergency basis effective November 18, 1997, to implement Public Act 90-0376 which authorizes HMOs to make basic outpatient preventative and primary health care services available to children under the age of 19 who are otherwise unable to obtain health care benefits. The emergency rule will expires April 16, 1998, but the rule is going through the regular rulemaking process. (Vol. 21, #48; Mary Petersen)
