Over the past several months, state insurance departments have learned that numerous claims under life and property insurance policies, annuities, and dowry policies sold in Europe, prior to and during World War II, were never paid to many Holocaust survivors or their heirs. As a result, state insurance regulators across the U.S. are joining in efforts to resolve the situation.
International Commission
One such effort is the establishment of an International Commission to pursue resolution of the outstanding insurance claims of Holocaust victims, survivors, and their heirs. As of April 30, 1998, Illinois and 35 other states, along with major Jewish organizations and European insurers, had committed to signing a "Memorandum of Intent" to accomplish the following:
Illinois has also been participating with other states in a National Association of Insurance Commissioners' Working Group which laid the foundation for resolution of the claims by identifying issues of concern and developing a strategy for cooperative resolution. A smaller group of state regulators will now take on the tasks of negotiating the specifics of an agreement to establish the international commission and defining the parameters for the claim handling operations.
An initial meeting between U.S. and European insurance regulators is scheduled for June 10 in London.
Consumer Outreach
Illinois is working with other states to assist in the establishment of a uniform, centralized claim processing system through referral of all claimants to the Holocaust Claims Processing Office (HCPO) operated by the New York State Banking Department. The HCPO has a staff of highly trained claims specialists who are available to provide assistance in eight languages (English, French, German, Hebrew, Polish, Russian, Spanish, and Yiddish). The HCPO staff assist claimants in filling out claim forms and collecting relevant documentation. The HCPO staff will file the claims with all appropriate bodies in Europe and follow-up on the claims submitted to ensure that thorough consideration is given. The HCPO provides its assistance to claimants free of charge.

In addition to the national level activities, the Illinois Department is working with the Jewish Federation of Metropolitan Chicago and several of its agencies, along with the Holocaust Memorial Foundation of Illinois and Sheerit Hapleitah of Metropolitan Chicago to identify and assist potential claimants living in Illinois in filing their claims for unpaid insurance proceeds. To that end, seminars will be held June 11th and 17th at the Holiday Inn North Shore, 5300 West Touhy, Skokie, Illinois.
Staff and volunteers will answer questions and assist Holocaust survivors and heirs with the submission of claims. Claim forms and assistance will be available from 4:00 p.m. to 8:00 p.m. on Thursday, June 11 and from 9:00 a.m. to 2:00 p.m. on Wednesday, June 17.
Kenneth Skiera was appointed Chief Examiner of the Life/Accident and Health Financial Examination Section on March 2, 1998. A 28 year Department veteran, Ken had served as Assistant Chief Examiner since 1979.
Donald Wulf was elected President of the Insurance Data Management Association on April 28. IDMA is an association of insurance professionals whose work involves the management of insurance data and information processing. Don is Assistant Deputy Director of the Department's Cost Containment Section.
Karen Vancil and William McAndrew were named to supervisory positions in the Consumer Services Section effective June 1 and July 1 respectively. A consumer services analyst since July 1974, Karen will head the Life/Accident and Health Unit. Bill joined the Department as legislative liaison in February 1993, and will oversee the Property and Casualty Unit.

The utilization of after-market or non-original manufactured (non-OEM) automobile parts has become extremely popular with the insurance industry. Illinois law permits the use of non-OEM parts provided the insurance company complies with the requirements of Illinois Insurance Code Section 5/155-29 regarding disclosure requirements and modification costs, as well as the warranty requirements provided under Part 919.
Department staff met recently with legislators and their constituents who are owners of auto body shops. Those individuals expressed concern that the insurance industry is:
Proper notification by the insurance company to the consumer as to warranty and fitness of the non-OEM parts is an integral and critical part of the Illinois Insurance Code and Part 919.
The Department will closely review all complaints filed and claim files surveyed in a market conduct examination to gauge full compliance with the Illinois Insurance Code and Department Regulation 919 and will take appropriate regulatory action where required.
On April 6, 1998, the Illinois Department of Insurance issued a bulletin (CB 98-6) to all licensed property and casualty insurance companies setting forth our position on the use of Year 200 (Y2K) exclusion endorsements. (CB 98-6) Year 2000 Coverage and Endorsements
Are we heading for a computerization collapse on January 1, 2000? Until the date arrives, no one will know the answers for sure and a state of virtual quandary will exist until then. Beyond the degree of damages looms the question: who will pay for this?
Because of all these speculations of damages and amounts of damages, the Department is concerned that the exposure cannot be accurately predicted. Accordingly, we will closely monitor all activities regarding Y2K endorsements including the following:
Personal Lines Coverages
Commercial Lines Coverages (including commercial property, commercial general liability, professional liability, business owners and similar packages)
If an insurer is nonrenewing the policy, the nonrenewal must comply with Section 143.17a of the Illinois Insurance Code (215 ILCS 5/143.17a) including:
Failure to comply with the requirements of Section 143.17a will result in an invalid nonrenewal and the company must renew the existing policy.
If an insurer is offering to renew the policy but attaching a Y2K exclusionary endorsement, or increasing the deductible, the company must comply with the Illinois Insurance Code [215 ILCS 5/143.17a subparagraph (b)], including:
Failure to comply with the requirements of Section 143.17a subparagraph (b) may result in the company being required to renew the policy for one policy period on the same terms and conditions as the expiring policy.
The Department may set standards for these notices pursuant to the filing requirements of Section 143(2) of the Illinois Code [215 ILCS 5/143(2)]. This Section, in part, states the Director may require the filing of ". . . other matter incorporated by reference . . ." into a policy of insurance issued in this state.
For those policies providing the more typical commercial liability and commercial property coverages, the Department has reviewed various Advisory Organization filings and will use the language in those filings as guidelines in reviewing independent filings. Company filings must specify the lines of coverage affected by the exclusion, the specific types of insureds the company is targeting for exclusion and the specific reasons the exclusions are needed. Blanket filings for all lines will not be accepted.
For policies providing professional liability coverages, independent exclusions or coverage modification endorsements will be considered on a case by case basis.
Department Monitoring and Enforcement Activities
The Department understands the concerns that Y2K responsibilities may be shifted to the insurance industry. While we encourage the business community to quickly resolve their problems regarding Y2K, this does not affect our position.
Because of the Department's concerns about how industry will address possible Y2K exposures, we will carefully monitor the marketplace both through complaints and market conduct examinations to determine if inappropriate Y2K-related activities are occurring.
Inappropriate Y2K-related activities will include, but not be limited to: canceling policies mid-term due to Y2K exposures; nonrenewing policies or using Y2K endorsements on a blanket basis as opposed to underwriting individual risks; using Y2K exclusions to the degree that marketplace disruption is evident; or, receiving consumer complaints regarding company abuses that are above norm due to Y2K-related exclusion activities.
If the Department determines that inappropriate Y2K-related activities are taking place, we will rigidly enforce all existing laws and regulations to provide remedial relief to consumers, including sponsoring new legislation to control insurance industry misconduct.

Copies of rules are also available upon written request to the Department of Insurance at a $1 per page charge. Adopted rules are codified in Title 50 of the Illinois Administrative Code.
Rule 4202 (Cost Containment Form and Data Reporting Requirements) was repealed effective March 3, 1998, and replaced with Rule 4203 (Insurance Cost Containment Data and Reporting Requirements) effective March 3, 1998. The revised rule clarifies the filing instructions, eliminates much of the data reporting required by Rule 4202, and reduces the filing requirement to once a year. (Vol. 22, #11; Bruce Hrabak)
Rule 4404 (Portability of Creditable Service Time for Downstate & Suburban Police Pension Funds) was adopted effective May 1, 1998, to implement Public Act 90-460 which requires the Department of Insurance to establish methodology for calculating the true cost of transferring creditable service time for certain public pension funds. This rule had been adopted on an emergency basis in December 1997. (Vol. 22, #20; Scott Brandt)
Rule 4415 (Payment of Annual Compliance Fees for Pension Funds) was adopted effective April 27, 1998, to implement Public Act 90-507 which requires Illinois public pension funds to pay an annual compliance fee. The rule establishes a payment mechanism for the fee. (Vol. 22, #19; James Orr)
Rule 4430 (Investment Fee Disclosure Requirements for Pension Funds) was adopted on March 31, 1998, to implement Public Act 90-507 which allows pension funds to make permitted investments beginning January 1, 1998. The rule addresses fee disclosure to ensure that pension funds obtain adequate information about the actual fees and costs incurred in conjunction with investment transactions. The rule had been adopted on an emergency basis in December 1997. (Vol. 22, #15; Jim Orr)
Rule 5421 (Health Maintenance Organization) was amended effective March 31, 1998, to implement Public Act 90-0376 which authorizes HMOs to make basic outpatient preventative and primary health care services available to children under the age of 19 who are otherwise unable to obtain health care benefits.
