Consent Order: $600 Fine; Reprimand; Prohibited from Teaching Violations: SR 1 of USPAP. Respondent failed to be aware of, understand, and correctly employ those recognized methods and techniques that are necessary to produce a credible appraisal, which resulted in a misleading appraisal report.

Consent Order: Revocation Violation: Ethics Provision (Conduct Section) and SR 1 and SR 2 of the USPAP. Respondent acted as an advocate for clients; rendered appraisal service in a careless and/or negligent manner which resulted in misleading appraisal reports; engaged in an unethical manner; and violated the terms and conditions of a previous Consent Order issued to him by this Agency.

FREEPORT:

Kirk Hughes, 1998-00136 – 12 28 1998

Consent Order: Revocation. Violations: Section 90 of the Illinois Real Estate Appraiser Licensing Act [225 ILCS 457] and the Ethics Provision (Conduct Section) of USPAP. Respondent falsely represented himself as an active State Licensed Real Estate Appraiser; and, fraudulently revised the expiration date on his appraiser certificate to indicate that he had complied with the provisions of Illinois Law and Rules, promulgated thereunder, which authorized him to engage in appraisal activities as a State Licensed Real Estate Appraiser.

Glenda Siegel-Bach, 1996-00123 -- 08 13 1998

Consent Order: $1,000 Fine; Reprimand Violation: SR 1 and 2 of the USPAP. Respondent failed to correctly employ recognized methods and techniques; and, communicated her analysis, opinion, and conclusion in a manner that was misleading.

HANOVER PARK:

Bryan Franks, 1996-00006 -- 11 05 1998

Order: Revocation Findings of Fact. Respondent was found to be in default by failing to appear at a Preliminary Hearing; failing to respond to the Hearing Officer's order to answer the Complaint; and, failing to appear at a Status Hearing. Conclusions of Law. 225 ILCS Sections 455/36.18(a) (1), (2), (5), (9) and 455/36.17(a) and 68 Ill. Admin. Code Part 1455.205(b) and (c).

Bryan Franks, 1996-00006 (Previously 1996-0173) – 12 28 1998

Consent Order: Petition for Restoration of revoked Illinois Real Estate Appraiser License granted and restored to an active status, effective 12/28/98; $1,000 Fine; Reprimand. Violations: 225 ILCS Sections 455/36.18(a) (1), (2), (5), (9) and 455/36.17(a) and 68 Ill. Adm. Code Part 1455.205(b) and (c). The Certificate of Registration issued to Respondent was revoked on November 5, 1998 by Order of the Commissioner of this Agency. The Order was issued based on certain Findings of Fact, Conclusions of Law and a Recommendation to the Commissioner by the Illinois Appraisal Board. In compliance with Section 1455.420 of the Rules of the Administration of the Real Estate Appraiser Certification, the Respondent filed a Petition for Hearing in reference to the restoration of his Illinois appraiser license.

Consent Order: $1,000 Fine; Reprimand Violation: Ethics Provision (Conduct Section) and SR 1-1 of the USPAP. Respondent acted as an advocate for his client by estimating a value higher than market value in selecting comparable sale properties with higher sale prices and ignoring more comparable sale properties that would have resulted in a lower value estimate; failed to be aware of, understand, and correctly employ recognized methods and techniques that are necessary to produce a credible appraisal; committed a substantial error of omission that significantly affected the appraisal; and, rendered appraisal service in a careless and negligent manner which resulted in a misleading appraisal report.

Consent Order: $500 Fine; Reprimand. Violations: SR 1 of USPAP. Respondent failed to be aware of, understand, and correctly employ those recognized methods and techniques that are necessary to produce a credible appraisal; specifically, rendering appraisal service in a careless and negligent manner which resulted in a misleading appraisal report.

Consent Order: $500 Fine; Reprimand Violation: Article 2 of the Real Estate License Act of 1983 and SR 1 and 2 of the USPAP. Respondent did not properly identify himself; failed to correctly employ recognized methods and techniques; and, communicated his analysis, opinion, and conclusion in a manner that was misleading.

NAPERVILLE:

Nitin Bhatt, 1997-00104 -- 09 30 1998

Consent Order: $2,500 Fine; Probation Violations: Ethics Provision (Conduct Section) and SR 1 and 2 of USPAP. Respondent acted as an advocate for his client; failed to employ methods and techniques that produce a credible appraisal; rendered service in a careless and negligent manner; and, developed and reported an appraisal report in a manner that was misleading.

Consent Order: Probation; $1,000; Education Violations: Ethics Provision (Conduct Section) and SR 1 and 2 of USPAP. Respondent acted as an advocate for his client; failed to be aware of, understand, and correctly employ those recognized methods and techniques that are necessary to produce a credible appraisal, which resulted in a misleading appraisal report; failed to communicate each analysis, opinion, and conclusion in a manner that is not misleading; and, failed to indicate on the appraisal report as being a Summary Report.

Consent Order: $2,000 Fine; Reprimand Violation: Ethics Provision (Conduct Section) and SR 1-1 © of the USPAP. Respondent engaged in unethical conduct by intentionally signing appraisal reports.

ROCHESTER:

Steven Anderson, 1996-00039 -- 09 30 1998

Consent Order: $500 Fine; Reprimand; Education Violations: Competency Provision and SR 1-1 and 1-4 of USPAP. Respondent failed to have the knowledge and experience to complete the appraisal assignment competently; failed to be aware of, understand, and correctly employ those recognized methods and techniques that are necessary to produce a credible appraisal; and, developed an appraisal without observing specific appraisal guidelines.

TEQUESTA, FLORIDA:

Roger Wozniak, Tequesta, FL, 1998-00049 -- 07 22 1998

Consent Order: $200 Fine; Reprimand Violation: Article 2 of the Real Estate License Act of 1983. Respondent falsified Real Estate Appraiser’s application in failing to indicate a previous Real Estate Broker’s License had been disciplined.

VERNON HILLS:

Respondent failed to understand and correctly employ those recognized methods and techniques necessary to produce a credible appraisal; rendered appraisal service in a careless or negligent manner which resulted in a misleading appraisal report; and, reported an appraisal that was misleading and could not be understood or relied upon.
